At I Do Prenup (“we,” “us,” or “our“), we recognize the importance of protecting your personal information and we are committed to being transparent about how we collect, use, and protect your personal information when you visit our website (“Site”) or use our Services.  Please also see our terms of use  to see how this Privacy Policy applies.

I Do Prenup is an Ontario-based technology company that provides information, content, tools and an online platform to help you organize your financial information and draft family law documents, such as prenuptial, marriage or cohabitation agreements(the “Services“). Our Services allow you to share your basic information and invite another user (such as your partner), separately complete asset disclosures and preferences, review and resolve any differences together and finalize, sign and securely store your agreement.  We may also provide additional services and features. Our Privacy Policy applies to visitors of our Site and users of our Services.

By using our Site or our Services, signing up for an account and voluntarily submitting personal information to us, you consent to the collection, use, and disclosure of your personal information in accordance with this Privacy Policy.

You may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. However, this may mean we can no longer provide our services to you.

We reserve the right to modify this Privacy Policy at any time. If we make material changes, we will notify you through this page or through other means to provide you an opportunity to review the changes before they become effective. By continuing to use our Services after we publish or notify you about changes to this Privacy Policy, you acknowledge that it is the updated Privacy Policy applies to your personal information as of the effective date. If you object to any changes, you may request to delete your account or your personal information, to the extent permitted by our record retention obligations. 

What Personal Information Do We Collect?

We collect personal information that you voluntarily provide to us to use our Services, to ask questions, to submit documents, to make a payment, to provide feedback or to subscribe to our communications. We only collect personal information that is directly related to our Services. We strongly encourage you not to provide us with information which is not necessary.

We collect your personal information directly from you or from the individual to whom it pertains. We may also collect personal information from other sources, such as your partner who may provide information about you as part of the Services. 

In order to provide you with our Services, we collect personal information that may include:

  • Identity Information such as your name, title, age, marital status, date of birth and contact details including your email, phone number and/or mailing address);
  • Family Information: Information about your partner, your children, including, name, date of birth and relationship to child, your current family situation, legal matter and inquiries.
  • Financial Information: Information about your income, bank accounts, assets, debts, real estate, financial investments and retirement accounts, vehicles and business interests.
  • Technical Information: Information automatically collected by our servers when you visit our Site including details about: your activity on our Site, information about your computer or device, such as operating system, Internet Protocol (IP) address, browser type, language, access time to our site, page that directed you to our Site.  
  • Payment information for billing purposes where applicable.
  • Other: Any other personal information that you voluntarily provide to us through our Site, contact or intake forms, including the content of any messages, feedback, comments or communications, information that you have consented to us collecting, or information that we are otherwise permitted by law to collect.

You do not have to provide personal information to us, though if you do not, it may limit your ability to use our Services.

How We Use Your Personal Information

We use your personal information for the following purposes:

  1. To provide you with our Services, including to help you fill out your questionnaire, generate documents, to administer your account.
  2. To communicate with you in order to send you updates, to answer your questions, to evaluate client satisfaction or for marketing purposes.
  3. To monitor and analyze website traffic and performance;
  4. To manage and improve our Site’s functionality and user experience.
  5. To comply with legal and regulatory requirements.
  6. To protect the legal rights, property, or safety of I Do Prenup, our users, or others.

How We Share Your Personal Information

We may disclose personal information in limited circumstances:

  • With your consent or at your direction, notably with individuals that you choose to invite to collaborate on our Site;
  • With third-party service providers to help us provide you with our Services, including hosting our data or processing payments, detecting fraud, providing customer support, marketing and development. Their access to your personal information will be limited to what is reasonably necessary to perform these tasks on our behalf and they are obligated not to disclose or use it for other purposes.
  • When required or permitted by law or where ordered to do so by a court order or a government warrant;
  • Where necessary to establish, exercise, or defend legal claims;
  • If you choose to use our optional features to reach a lawyer, we will share your personal information to complete your request.

We do not sell your personal information to third parties.

Because we are a technology company and not a law firm, your communications with us are not protected by lawyer-client privilege. While we keep your data strictly confidential, it does not have the legal protection that exists between a lawyer and their client.

We may collect personal information through cookies and similar technologies, collectively “Cookies”) to enhance your experience, ensure the security of our Site, and analyze how our services are used.

A cookie is a small text file that a website creates and accesses through your browser when you visit the site. Cookies are used for many purposes, such as to track language preferences, provide customized web page content, and display website navigation history.

We use cookies and other tracking technologies to:
– Recognize repeat visitors to our Site;
– Analyze traffic patterns and usage to improve site performance;
– Manage user sessions.

We use third-party services provided by Stripe to process payments and detect fraudulent activity. When you interact with our payment gateway, Stripe may set its own Cookies. By using our payment services, you acknowledge that your data may be processed by Stripe in accordance with their terms.

You can configure your browser to block or alert you about these cookies, but some parts of the Site (specifically the checkout process) may not work if Stripe’s security cookies are blocked. .   Please consult your browser settings (and browser extensions or plugins) which allow you to configure whether and how you receive cookies.

Email Communication and CASL Compliance

We comply with Canada’s Anti-Spam Legislation (CASL). You will only receive electronic communications from us if you have provided consent or if the communication is otherwise permitted by law.

If you sign up to receive email news, updates or communications from us, your email address will only be used to provide you with the requested service. If you do not wish to receive e-mail communications from us regarding new resources, you may unsubscribe at any point or e-mail us at hello@idoprenup.com.

How We Protect Your Personal Information

We have implemented reasonable and appropriate administrative, technical and physical security measures and safeguards to protect your personal information in our possession from loss or theft, unauthorized access, use or disclosure, modification or destruction. 

However, no method of transmission of data over the internet is completely secure and we cannot guarantee the security of the information that you send to us.

Data Storage and Cross-Border Transfers

Your personal information may be stored on servers located in Canada or in jurisdictions outside of Canada. We ensure appropriate protections are in place when transferring data. Other jurisdictions may have laws which are different from, and potentially not as protective as, the laws of Canada.

Retention and Destruction of Personal Information

We retain personal information as long as your account is active or as necessary to provided you with our Services and in accordance with legal obligations.  

We may retain some of your personal information even after you have closed your account if reasonably necessary to comply with our legal obligations, meet regulatory requirements, resolve disputes, maintain security, prevent fraud and abuse, enforce our Terms of Use, or fulfill your request to “unsubscribe” from further messages from us.

Your Privacy Rights

You have the right to access, request corrections or updates, withdraw your consent.

  • Access your Personal Information: You can ask for a copy of the personal information we hold about you.
  • Correct your Personal Information: You can correct or update your personal information through your account or ask us to correct or update it in certain cases.
  • Withdraw your Consent: You can ask withdraw or limit your consent to our use of your personal information, subject to legal limits. You can ask us to delete all or some of your personal information and/or your account.
